How WA Property Settlements Work

Under the Family Law Act 1975 (Cth), property settlements in Western Australia are governed by Sections 79 and 90SF. The court follows a four-step process to determine a fair division of the asset pool:

Identify and Value the Property Pool

All assets, liabilities, and superannuation interests are identified and valued at current market value. This includes real estate, vehicles, bank accounts, investments, business interests, and superannuation.

Assess Contributions

The court examines financial contributions (income, inheritances, asset purchases) and non-financial contributions (homemaker duties, parenting, renovations) made by each party during the relationship.

Consider Future Needs

Factors such as age, health, income-earning capacity, care of children, and the financial resources available to each party are weighed to adjust the percentage split.

Ensure Justice and Equity

The final step is a discretionary check: is the proposed division just and equitable in all the circumstances? This is not a mathematical formula — it requires legal judgment.

Is this calculator accurate for WA property settlements?
This tool accurately calculates the net asset pool and percentage splits based on the data you enter. However, it only addresses Step 1 of the four-step legal process. A fair legal outcome depends on contributions, future needs, and justice & equity — factors that require professional legal assessment.
How is superannuation treated in a property settlement?
Superannuation is treated as property under the Family Law Act. It can be split by court order (a "superannuation splitting order") where a portion of one party's super is transferred to the other party's fund. This tool includes super in the global pool, which reflects how the court approaches it.
Does the 50/50 starting point apply to every case?
No. There is no presumption of equal division in Australian family law. The starting point varies based on contributions and future needs. Long marriages with similar contributions often result in roughly equal splits, but short marriages or significant disparity in contributions can produce very different outcomes.
